Terms of Service

These Terms of Service govern the sale of products through the Growlet online store and your use of this website. Please read them before placing an order. By submitting an order you confirm that you have read and accept these terms. Nothing in these terms limits or excludes the rights you have as a consumer under mandatory European Union or national law.

1. Who we are

2. Who may place an order

You may place an order if you are at least 18 years old and have the legal capacity to enter into a binding contract, or if you are between 16 and 18 and have your parent's or guardian's consent.

By ordering you confirm that the information you provide is accurate and complete, and that you are ordering for your own use rather than for resale.

3. Products and descriptions

We describe our products as accurately as we can. Photographs are illustrative: the colour you see depends on your screen, and slight variations in shade, finish and dimensions are normal for moulded plastic products.

The tray is designed to sit in a standard cup holder, such as those built into child car seats, centre consoles and doors. Because cup holder sizes vary, we recommend measuring yours before ordering. If in doubt, ask us before you buy.

The product is intended to hold snacks, drinks and small toys during normal driving. It is not a safety device, it is not a substitute for a child restraint system, and it must not be used in a way that obstructs the driver, a seat belt or an airbag.

4. Prices

All prices are shown in euros and include value added tax at the applicable rate, unless stated otherwise at checkout.

Delivery costs are shown separately and are added to the price of the goods before you confirm payment. The total you will be charged is always displayed before you complete the order.

We may change prices at any time, but a change will never affect an order we have already accepted.

Prices are published with care, but errors can occur. If we discover an obvious pricing error after you have ordered, we will contact you before dispatch and you may either confirm the order at the corrected price or cancel it for a full refund.

5. How a contract is formed

Product listings on this website are an invitation to make an offer, not a binding offer to sell.

When you complete checkout and pay, you are making an offer to buy. The contract between us comes into existence only when we send you an order confirmation or dispatch the goods, whichever happens first.

We may decline an order — for example if the product is unavailable, if we cannot deliver to your address, if a pricing error has occurred, or if we suspect fraud. If we decline after payment has been taken, we will refund you in full without undue delay.

6. Payment

Payments are processed by Stripe. Depending on your location, you may pay by card or by another method offered at checkout.

Your card details are entered on Stripe's secure payment page and are never received or stored by us.

Payment is taken at the time you place your order. Goods remain our property until payment has been received in full.

7. Delivery

Orders are delivered by courier to the address you provide at checkout. Please check it carefully, as we cannot redirect a parcel once it has been dispatched.

We currently deliver to the countries listed at checkout. Estimated delivery time is [DELIVERY TIMEFRAME] from dispatch. Estimates are given in good faith but are not guaranteed, as delivery depends on the courier.

Where the law of your country makes us responsible for the goods until they reach you, risk passes to you when you, or someone you have nominated, takes physical possession of the parcel.

If your order has not arrived within a reasonable time, contact us and we will investigate with the courier. If delivery fails, you are entitled to a replacement or a refund in accordance with consumer law.

8. Your right to withdraw from the contract

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days without giving any reason, under Directive 2011/83/EU on consumer rights.

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you, acquire physical possession of the goods.

To exercise this right, tell us of your decision by a clear statement sent to [CONTACT EMAIL] before the period expires. You may use the model withdrawal form set out in the Directive, but you are not obliged to.

You must send the goods back without undue delay and in any event within 14 days of telling us. You bear the direct cost of returning the goods unless we have stated otherwise.

We will refund all payments received from you, including the standard delivery cost, without undue delay and no later than 14 days after we are informed of your decision. We may withhold the refund until we have received the goods back or you have supplied proof of return, whichever is earlier.

You are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

9. Returns and refunds

Our Refund and Return Policy sets out how to return an item and how refunds are processed. It forms part of these terms.

Refunds are made using the same payment method you used for the original transaction, unless you expressly agree otherwise. You will not incur any fee as a result of the refund.

10. Legal guarantee of conformity

We are legally obliged to supply goods that conform to the contract. If your item is faulty, damaged on arrival, or not as described, you have statutory remedies under Directive (EU) 2019/771 on the sale of goods.

Within two years of delivery you may require the goods to be repaired or replaced free of charge and, where that is impossible, disproportionate or not carried out within a reasonable time, you may require a price reduction or terminate the contract.

These statutory rights exist alongside your right of withdrawal and are not affected by it. Contact us at [CONTACT EMAIL] with a description of the problem and, where possible, a photograph.

11. Safe use of the product

Use the tray only in a cup holder it sits firmly in, and check that it is stable before every journey.

Do not place hot liquids, heavy objects, or anything that could cause injury if it moved suddenly on the tray. Do not allow the tray to obstruct a seat belt, an airbag, the driver's view or the vehicle's controls.

The tray is intended for use while the vehicle is being driven normally. It cannot be relied on to hold its contents during heavy braking or a collision.

Keep small parts away from very young children, and supervise children while the tray is in use.

12. Our liability

We are liable for foreseeable loss and damage caused by our failure to comply with these terms or by our negligence.

We are not liable for loss or damage that was not foreseeable, for loss arising from use of the product contrary to the safety guidance above or to any instructions supplied with it, or for business losses, since our products are supplied for private use.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under applicable law. Your statutory rights as a consumer are unaffected.

13. Intellectual property

The Growlet name, the content of this website, its text, photographs, layout and design are owned by us or used under licence, and are protected by copyright and other intellectual property rights.

You may view and print pages from this site for your own personal use. You may not reproduce, republish or use them commercially without our written permission.

14. Acceptable use of the website

You agree not to use this website in any way that is unlawful or fraudulent, to attempt to gain unauthorised access to any part of it, or to interfere with its normal operation.

We may suspend or withdraw access to the site, temporarily or permanently, without notice. We do not guarantee that the site will always be available or free from errors.

15. Events beyond our control

We are not responsible for delay or failure to perform our obligations where this is caused by an event beyond our reasonable control, such as extreme weather, strikes, transport disruption, failure of public networks, or acts of government.

If such an event occurs we will contact you as soon as possible and take reasonable steps to limit the delay. If the delay becomes substantial, you may cancel your order and receive a refund for goods not delivered.

16. Personal data

We process the personal data you provide when ordering in accordance with our Privacy Policy, which explains what we collect, why, how long we keep it, and what rights you have.

17. Complaints and dispute resolution

Consumers resident elsewhere in the European Union may apply to the equivalent out-of-court dispute resolution body in their own country. Your right to bring proceedings before a court is unaffected.

18. Governing law and jurisdiction

These terms and any contract formed under them are governed by the law of [COUNTRY].

If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory rules of the country in which you habitually reside, and you may bring proceedings in the courts of that country.

19. Changes to these terms

20. Other terms

If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions continue in full force.

If we do not insist that you perform an obligation, or delay in enforcing our rights, that does not mean we have waived those rights.

A contract under these terms is between you and us. No other person has any right to enforce it.
